IncrediBuild – Terms of Service & Privacy

1. Acceptance

By accepting a quote, paying a deposit, or instructing us to begin work, you agree to these Terms. Acceptance may be written, verbal, or by conduct.

2. Quotes & Scope

Quotes are based on the following assumptions unless stated otherwise:

  • Safe and reasonable site access

  • Existing structures are sound and serviceable

  • No asbestos or hazardous materials present

  • Standard low–mid range fixtures unless specified

  • No major structural repairs required

  • Stormwater suitable for connections (plumbing excluded unless stated)

  • Client provides timely decisions and clears work areas

Any work outside this scope is a variation (see Section 5).

3. Construction Services

We provide building, renovation, and project management services and may engage subcontractors. Relevant project information may be shared with them to complete the work.

4. Payment Terms (Construction Contracts Act 2002)

All invoices are Payment Claims under the Construction Contracts Act 2002

Deposit

We may adjust the deposit requirement at our sole discretion based on project risk, customised materials, or upfront procurement costs.

A deposit is required before work commences. The standard deposit is 30%, however:

We reserve the right to require a deposit of up to 50% or 100% depending on:

  • The size and scope of the project

  • The level of financial risk involved

  • The cost of materials or upfront commitments requiredWork will not begin until the deposit is received in full.

Work will not begin until the deposit is received in full.

Progress Payments

Depending on the size and type of job we may invoice:

  • At project milestones, or

  • Weekly/fortnightly based on work completed and materials supplied

Payment Due

  • Due within 7 working days of invoice

  • No retention unless agreed

Final Payment

  • Due upon practical completion

Payment Schedule

  • Must be provided within 5 working days of a payment claim

  • If not, payment becomes fully payable


5. Variations

A variation includes:

  • Changes in scope, materials, or design

  • Client-requested extras

  • Unforeseen site conditions

Approval

  • Must be approved in writing (email accepted)

  • Urgent work may proceed without prior approval if required for safety

  • Charged at agreed price or time + materials

  • May increase cost and extend timelines

6. Late Payment & Suspension

If unpaid:

  • Interest: 1.5% per month (daily)

  • Client pays all recovery/legal costs

  • We may suspend work without notice under the Act

  • We reserve the right to reclaim our materials

7. Site Conditions & Delays

We are not responsible for delays caused by:

  • Weather

  • Supply issues

  • Client delays

  • Variations

  • Hidden defects

Unforeseen conditions may result in additional charges.

8. Health & Safety (HSWA 2015)

We maintain a safe worksite. The Client must:

  • Restrict site access

  • Follow safety instructions

  • Ensure visitors sign in

We may restrict access during works.

9. Materials & Ownership

  • Materials remain ours until paid in full

  • Risk passes to the Client on delivery/installation

10. Liability

To the extent permitted by law:

  • No liability for indirect/consequential loss

  • Liability limited to value of work supplied

11. Cancellation

If cancelled:

  • Deposit may be retained

  • Work completed and costs incurred are payable

12. CCTV

CCTV may be used on sites for:

  • Security

  • Safety compliance

  • Incident investigation

Footage is securely stored and access restricted.

13. Privacy

We collect and use personal information to:

  • Provide services and quotes

  • Manage projects and communicate

  • Meet legal obligations

We may share data with subcontractors and service providers but never sell it.

We may use:

  • Cookies and analytics

  • Google/Facebook advertising tools

You may request access or correction of your data at any time.

14. Marketing Compliance

We comply with the Unsolicited Electronic Messages Act 2007:

  • No spam

  • You can unsubscribe anytime

15. Governing Law

These Terms are governed by New Zealand law.
